1. Introduction

These Terms of Service ("Terms") govern your access to and use of the products, services, and website provided by IK Lab ("we," "us," or "our"), accessible at iklab.dev. Our products include CasePilot and BugPilot, which are software-as-a-service (SaaS) extensions for Microsoft Azure DevOps (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

IK Lab provides AI-powered developer tools that integrate with Azure DevOps:

  • CasePilot: An AI test case generator that analyzes user stories and automatically generates comprehensive test cases using a two-pass AI approach.
  • BugPilot: An AI bug report enhancer that transforms vague or incomplete bug reports into detailed, actionable tickets with structured reproduction steps and technical context.

Both extensions process work item content (user stories, bug reports) by sending it to our API for AI analysis. Results are returned directly to your Azure DevOps environment.

3. Accounts and Registration

To use certain features of our Services, you may need to create an account or authenticate through your Azure DevOps organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized use of your account.

4. Free Tier and Paid Plans

We offer a free tier that provides limited access to our Services, allowing you to evaluate the product before committing to a paid subscription. The specific limits of the free tier (such as the number of AI-generated outputs per month) are described on our website and within the extensions.

Paid subscription plans are available for users who require higher usage limits or additional features. Plan details, pricing, and feature comparisons are published on our website and may be updated from time to time.

  • Paid plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
  • All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to Stripe's terms and authorize recurring charges to your payment method.
  • Prices are listed in USD unless otherwise specified and are exclusive of applicable taxes.
  • We reserve the right to change pricing with at least 30 days' advance notice. Price changes will apply at the start of your next billing cycle following the notice period.

5. Refunds and Cancellation

You may cancel your paid subscription at any time. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period. You will not be charged again after cancellation.
  • You will retain access to paid features through the remainder of your billing cycle, after which your account will revert to the free tier.
  • No prorated refunds are issued for partial billing periods.

If you believe you have been charged in error or are dissatisfied with the service, please contact us at [email protected] within 14 days of the charge. We will review refund requests on a case-by-case basis and may issue a full or partial refund at our discretion.

6. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services to process, transmit, or store content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of our Services or underlying AI models.
  • Use automated scripts, bots, or other means to access the Services in a manner that exceeds reasonable usage or places an unreasonable load on our infrastructure.
  • Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Services.
  • Resell, redistribute, or sublicense access to the Services without our prior written consent.
  • Use the Services in any way that violates applicable local, national, or international laws or regulations.

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these acceptable use provisions.

7. Intellectual Property Rights

Our IP: The Services, including all software, algorithms, AI models, designs, trademarks, logos, and documentation, are the exclusive property of IK Lab and are protected by intellectual property laws. These Terms do not grant you any ownership rights in or to the Services.

Your Content: You retain all rights to the content you submit to the Services (such as user stories and bug reports). By using the Services, you grant us a limited, non-exclusive, revocable license to process your content solely for the purpose of providing the Services to you. We do not claim ownership over your content.

AI-Generated Output: The test cases, enhanced bug reports, and other outputs generated by our AI tools based on your input are provided to you for your use. You may use these outputs in your projects without restriction. We make no claim of ownership over AI-generated outputs produced from your content.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. AI-generated outputs are provided as suggestions and should be reviewed by qualified professionals before use. We are not responsible for decisions made based on AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IK LAB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by canceling your subscription (if applicable) and ceasing to use the Services. Upon termination:

  • Your right to access the Services will immediately cease (or at the end of your current billing period, if canceling a paid plan).
  • We may delete your account data after a reasonable retention period, subject to legal obligations.
  • Provisions of these Terms that by their nature should survive termination will remain in effect, including intellectual property rights, disclaimers, limitation of liability, and dispute resolution.

11. Indemnification

You agree to indemnify, defend, and hold harmless IK Lab and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction, as permitted by applicable law.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective date" at the top of this page and notify you through reasonable means, such as email or a prominent notice on our website, at least 30 days before the changes take effect.

Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Services and cancel your subscription.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IK Lab regarding your use of the Services and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
